Welcome to Opulent. These Terms of Service govern your use of the Opulent mobile application and related services. By using the Service, you agree to be bound by these Terms.
By creating an account or using Opulent, you agree to comply with these Terms. Account holders must be 18 or older. If you are between 13 and 17, a parent or legal guardian must create and own the account on your behalf. All payments will be made to the account owner (the parent or guardian) until you turn 18.
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
Account holders must be at least 18 years old to own an Opulent account, upload content, subscribe to the Producer Tier, or enter into any commercial agreement on Opulent. Under South African law, a minor cannot legally sign a binding commercial contract. If you are under 18, a parent or legal guardian must create and own the account on your behalf, and all payments will be made to that account owner until you turn 18.
If you are under 18: a parent or legal guardian must create and own the account for you. They will receive any payments until you turn 18. You may still be credited and featured under your own stage name.
Opulent offers Free, Premium, and Producer subscription tiers, as well as individual album purchases. All payments are processed securely through Paystack.
When you purchase an album or track, you receive a license to access and download that content for personal use. You do not own the content or the intellectual property rights therein.
Downloads are available to Premium and Producer subscribers. Downloaded content is licensed for offline personal use and may not be redistributed.
Opulent is exclusively for independent artists not registered with any collection society (SAMRO, CAPASSO, SAMPRA, or similar). By uploading content, you warrant that you own or have the necessary rights, you are not registered with any collection society, the content does not infringe third-party intellectual property rights, and you are at least 18 years old.
Artists receive 70% of net revenue from album/track sales. Opulent retains 30% as a platform fee.
For subscription revenue, Opulent operates a Pro-Rata Streamshare model. 70% of all net monthly subscription revenue is placed into a Creator Pool. Your share = (Your Streams — Total Platform Streams) — Creator Pool. The value of a stream fluctuates each month.
All revenue is held in a provisional clearing account for 45 days before becoming available for withdrawal. This protects against fraudulent uploads and copyright disputes. Revenue is tracked in real time in your Producer Dashboard.
Every upload is logged with an auditable digital trail including account ID, IP address, device information, upload timestamp, a digital fingerprint (hash) of the audio file, and confirmation of age verification and collection society status declaration.
You own your music 100%. We don't touch your copyright. We distribute it and pay you 70% of what it earns.
If a collection society comes after us because of your music, that's on you — not us.
If you join a collection society later, you must stop uploading and notify us within 7 days.
You agree not to use the Service for any illegal purpose, attempt unauthorized access, redistribute downloaded content commercially, use automated tools to access the Service, harass or harm other users, or upload content that infringes intellectual property rights.
All content on Opulent is protected by copyright. Artists retain ownership of their uploaded content. Opulent retains ownership of the platform and its features.
Opulent is provided "as is" without warranties. We are not liable for any damages arising from your use of the Service.
We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time through the app.
These Terms are governed by the laws of the Republic of South Africa.
