DMCA / Take-Down Policy

Opulent respects intellectual property rights and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA") and the South African Copyright Act 98 of 1978, we respond expeditiously to claims of copyright infringement.

1. Safe Harbour & Intermediary Status

Opulent is an online service provider under the DMCA. We host user-uploaded content but do not actively monitor it for copyright infringement. As a hosting intermediary, we are entitled to Safe Harbour protection.

• We are not liable for copyright-infringing content uploaded by users, provided we act promptly on valid take-down notices
• We will remove or disable access to infringing material within 24—48 hours of receiving a valid notice
• We maintain a repeat-infringer policy and will terminate accounts of users who repeatedly upload infringing content

2. How to File a Take-Down Notice

Send a written notice to our copyright agent containing:

1. Your physical or electronic signature
2. Identification of the copyrighted work you claim has been infringed
3. Identification of the infringing material and its location on Opulent
4. Your full name, email address, phone number, and mailing address
5. A good faith statement: "I have a good faith belief that the use of the copyrighted material is not authorised by the copyright owner, its agent, or the law."
6. An accuracy statement under penalty of perjury

3. What Happens After You File

1. Acknowledgement within 24 hours
2. Review & Removal within 24—48 hours if the notice is valid
3. Notification to uploader with a copy of your notice
4. Counter-Notice option — the uploader has 10—14 business days to file a court action, or we may restore the content

4. Counter-Notice Procedure

If your content was taken down in error, file a counter-notice containing your signature, identification of the removed material, a good faith statement under penalty of perjury, your contact details, and consent to South African court jurisdiction. Send counter-notices to the same email address above.

5. Repeat Infringers

Accounts subject to more than two valid take-down notices will be terminated.

6. Governing Law

This policy is governed by the laws of the Republic of South Africa, including the Copyright Act 98 of 1978 and the ECT Act 25 of 2002. The DMCA Safe Harbour provisions (17 U.S.C. — 512) also apply for international users.
